1st Article : Conditions acceptance
It is advised that you read all the below terms and conditions before making a purchase on Mobiliparts.com. The use of the Mobiliparts.com website and the subsequent purchase of the product(s)/service(s) advertised confirms that you are agreeing to such terms and conditions. These Terms and Conditions apply to all transactions on this site. Please read them carefully. They do not affect your statutory rights. We may change these terms and conditions at any time. Any changes will take effect on the date they are posted onto the site. You will be asked to read and accept the terms and conditions each time you place an order, to ensure that you are familiar with the most current ones.
2nd Article : Price
All prices shown on Mobiliparts.com are inclusive of French V.A.T at 19.6%.
In the unlikely event of an incorrect advertised price for a product on Mobiliparts.com, Mobiliparts can refuse to complete the transaction. Once a pricing error is noticed for a particular product all customers purchasing such a product will be informed using the given contact details. In such a situation the customer will be given the option to complete the order at the correct product price (not the incorrect advertised price) or cancel the order. If a customer cannot be contacted the order will be cancelled automatically. All payments made (for the order being cancelled) prior to the cancellation of an order will be refunded in full.
Delivery charges will be stated before payment is made. Delivery charges are non-negotiable and are subject to the delivery address.
Prices are, by default, quoted on mobiliparts.com in EURO (EUR)
Payments must be received in EUR. For international customers the credit/debit card company must convert payments into EUR using the current rate. Please note that both charges and refunds are in EURO and Mobiliparts cannot be held responsible for any loss due to exchange rate fluctuations.
No item will be delivered until full payment is received.
3rd Article : VAT and taxes
- Delivery within metropolitan France
Articles ordered are liable for the French VAT as well as the transport costs.
- Delivery Overseas
Any order implying an overseas delivery is exempted of French metropolitan VAT. This exemption concerns the selling price of products and the shipping costs.
The invoice will be elaborated without VAT.
However, at the arrival of the order, the buyer will have to clear customs and settle rights and taxes for the entry of the product(s) in his territory.
- Delivery within the European Community
Ordered goods are liable for French VAT. No tax is due at the reception, and the VAT is not refundable. If you are a company and if you have an intra-EEC VAT number, the invoice will be established without the French VAT. Important notice: all intra-EEC VAT numbers are checked before payment and delivery. If the number does not exist, order will be automatically cancelled.
- Delivery outside of the European Community and rest of world
You benefit from the tax exception on our products and our shipping cost.
The invoice will be established without any VAT. However you should settle rights and taxes for the entrance to your country and assure yourself beforehand that the ordered products are authorized for importation in your country.
4th Article : Payment
Payment for the goods and delivery charges can be made by any method shown on Mobiliparts website at the time you place your order. Payment shall be due before the delivery date and time for payment shall be a fundamental term of this agreement, breach of which shall entitle Mobiliparts to terminate the contract immediately.
Specific information about the credit card process :
Once you have gone through our checkout, you will be diverted to our protected secure online payment system with our credit card processors, either SPPLus from Caisse d’Epargne (one of the largest French bank) or Paypal. Your credit card information will be held in protected SSL secure servers at our Merchant providers only, we will not have access to your credit/debit card details, and we will not release information regarding your credit card. Your credit card details will only be used for transaction authorised by you.
There will be no delivery until cleared funds are received.
5th Article : Delivery
Products are sent within 48h to the address specified in the order process.
Shipping is exclusively made by the French Post. Once we ship out a product, an email is automatically sent to the consumer with the "La Poste" tracking number.
All our shippings can be tracked so that the consumer can be guaranteed whether the parcel has been received.
Shipping cost and time depend on destination countries :
- Metropolitan France: 3,99€ TTC within 48H*
- Nearby Europe (Germany, Denmark, Spain, Finland, Ireland, Netherlands, Portugal, United Kingdom and Sweden): 10,49€ TTC within 3 working days*
- Switzerland: 8.49€ HT within 3 working days*
- Rest of Europe: 15€ TTC within 4-8 working days* (depending on the destination)
- World: 17.99€ HT within 4-8 working days* (depending on the destination)
*Shipping time are given for information only by the French Post, Mobiliparts cannot be held as responsible for the consequences due to a shipping delay.
6th Article : Products warranty
All goods supplied by Mobiliparts are warranted free from defects, as decribed in the articles 1641 to 1649 of the French Civil code.
This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by Mobiliparts, failure to follow Mobiliparts´s instructions, or any alteration or repair carried out without Mobiliparts´s approval.
For repairs under warranty, return the item to Mobiliparts and we will take care of warranty repairs or replacement. In these circumstances you will also be responsible for the cost of carriage to and from Mobiliparts.
Following products are not subject to warranty :
• Cradles
• Screen protection
• Cables, chargers, adapters
• Stylus
• Earphones
• Cases (Sillicon, leather, crystal, metal)
7th Article : Complaints
If the goods supplied to you are damaged on delivery, you should notify Mobiliparts in writing via a registered mail within 5 working days, with as reference the Order number.
If the invoice is sent to you with a defect, you should notify Mobiliparts in writing via a registered mail within 5 working days, otherwise they will be considered as accepted.
8th Article : Limitation of liability
Mobiliparts SARL excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem you notify to Mobiliparts and Mobiliparts Limited shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:
• any incorrect or inaccurate information on Mobiliparts.com
• any interruptions to or delays in updating Mobiliparts.com
• the infringement by any person of any Intellectual Property Rights of any third party caused by their use of Mobiliparts.com or any product purchased through Mobiliparts.com
• any loss or damage resulting from your use or the inability to use the Mobiliparts.com web site or resulting from unauthorised access to, or alteration of your transmissions or data in circumstances which are beyond our control
• any loss of profit, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong
• any amount or kind of loss or damage due to viruses or other malicious software that may infect a users computer equipment, software, data or other property caused by persons accessing, using Mobiliparts.com
Si notre responsabilité était retenue à la suite de l'inexécution ou de la mauvaise exécution de notre contrat, le total des indemnités ne pourrait, de convention expresse, dépasser un montant égal au prix de la marchandise qui est à l'origine du dommage.
9th Article : Right of cancellation
You have the right to cancel the contract (as described in the L.121-16 of the French Consumer Code) at any time up to 7 days after you receive the goods. Please note that this policy has some limitations :
To exercise your right of cancellation, you must give written notice to Mobilipats by, post or the contact section of the website, giving details of the goods ordered and (where appropriate) their delivery. If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to Mobiliparts at your own cost. The goods must be returned to the address shown within the "Privacy Notice" section of the website. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit.
Once you have notified the Supplier that you are cancelling the contract, Mobiliparts will refund or re-credit you within 30 days for any sum that has been paid by you (excluding delivery costs and card processing fee) or debited from your credit card for the goods.
Except in the case of faulty or misdescribed goods, if you do not return the goods as required, Mobiliparts may charge you a sum not exceeding the direct costs of recovering the goods.
10th Article : Refund conditions
For accepted (conditions detailed in the 9th articles) refunds, Mobiliparts will only provide a commercial credit allowing the consumer to buy another product of the same value.
This commercial credit will expire after 6 months, unless the contrary is specified by Mobiliparts. It will be usable on alll Mobiliparts products or services.
11th Article : Applicable law
These above terms constitute the full agreement between the consumer and Mobiliparts SARL and may only be amended in writing. They apply to the exclusion of all other terms or conditions of contract proposed.
Use of Mobiliparts and these terms are subject to the laws of France and the jurisdiction of the French Courts.
In case of disagreement, the only court that will be able to judge is the one of Mobiliparts headquarter district : Hauts de Seine, 92, France
